⚖️ Terms & Conditions – Liability Waiver, Indemnification & Return Policy

By purchasing, using, or reselling this product, the purchaser (“Buyer”) agrees to the following:

1. Assumption of Risk
The Buyer acknowledges that the product involves the use of pressurized air/nitrogen/gas systems and mechanical components, which may present inherent risks, including but not limited to equipment failure, personal injury, property damage, or death. The Buyer voluntarily assumes all risks associated with the use, handling, installation, or modification of the product.

2. No Warranties
This product is provided “as is” and “as available,” without any warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or safety under all conditions.

3. Limitation of Liability
To the fullest extent permitted by law, the Seller shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to the use or misuse of the product, including but not limited to personal injury, property damage, loss of business, or financial loss.

4. Buyer Responsibility
The Buyer agrees that they are solely responsible for:

• Proper installation and use of the product

• Ensuring compliance with all applicable laws, regulations, and safety standards

• Training employees or users in safe operation

• Inspecting and maintaining all components, including tanks, valves, regulators, and fittings

5. Indemnification
The Buyer agrees to indemnify, defend, and hold harmless the Seller, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to:

• The use or misuse of the product

• Modifications or alterations made after purchase

• Failure to follow proper safety procedures

• Any injury, damage, or loss caused in whole or in part by the Buyer or third parties

6. Commercial Use Acknowledgment
The Buyer acknowledges that this product is intended for commercial/industrial use by trained professionals and not for consumer use.

7. Acceptance of Terms
By completing a purchase, the Buyer confirms that they have read, understood, and agreed to these Terms & Conditions in full. Acceptance of these terms is a condition of sale.

8. Return Policy

All sales of BeadGuard dispensers and VCI Vapor Generator cartridges are final with no exceptions. Notwithstanding the foregoing, the Company will accept returns or replacements solely for products that are received damaged during shipping. Customers must notify the Company by email or phone within 5 business days of delivery and provide clear photographic evidence of the damage, including the product and original packaging. Failure to provide timely notice and supporting documentation may result in denial of the claim. Upon verification of the damage claim, the Company reserves the right, at its sole discretion, to issue a replacement only of the damaged product.
